AUCTION RULES

  • All sales are final. Your bid, oral or written, constitutes a legal and binding contract.

  • No item will be sold for less than its minimum bid. Any bid that does not exceed the previous bid by at least the minimum increment will be considered invalid.

  • Indecipherable bids will not be honored. The auction official shall have sole and final

discretion to determine the successful bidder or to re-offer and resell articles in dispute.
  • All items are sold as-is. The American Cancer Society (ACS) makes no warranties, assumption liability, or representation of any kind with respect to any items, trips, or services described in this program/catalog and sold at the auction. ACS reserves the right to change or withdraw any auction lot or any part of an auction lot, at any time prior to the actual sale.

  •  Payment in full on September 26, 2021 is mandatory. Failure to do so will forfeit the item to the next highest bidder. Payment must be made with Visa, MasterCard, or American Express.

  •  If ACS is prevented by fire, theft, or any other reason whatsoever from delivering any

property to the successful bidder, the American Cancer Society’s liability shall be limited to the sum actually paid by the successful bidder.
  •  It shall be the responsibility of the successful bidder of services to contact the donor to arrange the time and place of delivery.
  • Reservations for the use of homes, condominiums, and private catering must be mutually arranged between the donor and successful bidder unless otherwise specified. The successful bidder of the use of a private home, condo, or club may not

sell or give this privilege to a third party.
  •  Successful bidders should retain the auction receipt for their records. Values listed on the receipt are estimated by the donor and are not warranted by the American Cancer Society. Please consult your tax advisor for specific IRS regulations.

  • Guests will be charged California Sales Tax on the tangible items in auction.
